Guest Blogger: New Hampshire Falls Short On Education Guarantee

The New Hampshire Superior Court recently granted a motion for summary judgment to the New Hampshire Coalition for Adequate Funding of Education (NHCAFE) in NHCAFE v. State of New Hampshire, the latest case challenging what financial support the state must constitutionally provide to towns for their public schools. In saying that the petitioner was entitled to the judgment as a matter of law, the court emphasized the New Hampshire Supreme Court's ruling in Claremont School District v. Governor (1997, commonly referred to as Claremont II) that "a constitutionally adequate public education is a fundamental right" and that the state has a duty to enforce that right.
Citing Claremont II and Claremont School District v. Governor (Accountability), the court said that the state has four mandates it must fulfill in order to meet its constitutional obligation in providing adequate public education: define an adequate education, determine the cost, fund it with constitutional taxes, and ensure its delivery through accountability. According to the opinion, the state has failed to do three of those four, only managing to fund public education with constitutional taxes.
With regard to defining adequate education, the opinion reiterated the New Hampshire Supreme Court's holding that the responsibility to define a constitutionally adequate education belongs to the legislature and governor. The opinion stated the same concerning cost determination, adding that in the current school funding system, the legislature "has made no provision whatsoever... to determine the cost of an adequate education. Rather, it has arbitrarily set the amount which it is willing to dedicate to the task of providing an adequate education." This is not close to sufficient.
Concerning the final missing mandate, the Superior Court relied on Claremont School District v. Governor (Accountability), stating that accountability "means that the State must provide a definition of a constitutionally adequate education, the definition must have standards, and the standards must be subject to meaningful application so that it is possible to determine whether, in delegating its obligation to provide a constitutionally adequate education, the State has fulfilled its duty." After recounting state education statutes and regulations, the court decided that neither in part nor in total do they meet that standard of accountability as established by the NH Supreme Court.
The state has appealed the case, and the legislature has been active recently too, attempting to pass amendments to New Hampshire's constitution that would seriously alter its guaranteed right to public education. As it has for years, this legal struggle pits those who consider education a fundamental right against those who consider it a fiscal policy matter.
