Professor Laurence Tribe Decides Not To Update American Constitutional Law

Pre-eminent constitutional law scholar and featured speaker at this year's ACS National Convention Professor Laurence Tribe has decided not to publish the second volume of the third edition of his influential treatise American Constitutional Law. His letters explaining the decision are here.

Professor Jack Balkin comments on the development:

For many years, Tribe has been a key exponent and defender of a liberal synthesis of the constitutional law created by the Warren and Burger Courts. Because Tribe has seen his job as synthesizing and reconstructing the larger themes of constitutional law as it actually exists, several of his positions have changed over the years as the Supreme Court (and existing doctrine) have become more conservative. Yet at the same time, the Rehnquist Court has pushed the liberal civil rights agenda in ways that the Warren and Burger Courts never did, for example, in the area of gay rights. Hence, until this moment, Tribe has worked on the assumption that the Supreme Court, even if it has not decided every issue in the ways he would prefer, has been working within the basic paradigms of reasoning established by the Warren and Burger Courts. Apparently, Tribe now believes that this may no longer be the case, and that a Supreme Court stocked with new Bush appointees will shift constitutional doctrine in important new directions. Perhaps equally important, Tribe appears to believe that the new Court will shift doctrine in directions that will make his synthesis of existing doctrine outmoded or irrelevant.

Whether or not he turns out to have been correct, Tribe's decision to suspend his treatise marks an important moment in American constitutional scholarship. It is important not simply because Tribe and his treatise are important, but because Tribe has symbolized the liberal establishment in American constitutional law for many years, and because, as a seasoned litigator, he is as good a judge of future trends as anyone else in the country. When Larry Tribe says that a paradigm shift may be on the way, it is worth sitting up and taking notice.

I cannot think of a scholarly decision of similar symbolic importance.

In response to the "Almighty Transportation Security Adiministration", Why isn't the Inspector General, U.S. Attorney, FBI or Homeland Security investigating their people who released "TOP SECRET" and "Sensitive Security Information" to the news media in violation of Title 50 U.S. Code, "National Security Act"? How did these "SSI" documents get to be made public. It started when I, was accused in September 2004 of "Impersonating a Police Officer" and Carrying a Loaded Hangun aboard an Alaska Airlines flight in July 2004 while I had a Arrest Warrant in hand, and a Federal Prisoner in Custody, who alledgedly escaped from Oregon and Washington State. The FBI obtained an illegally obtained Search and Seizure Warrant and raided my home on September 21, 2004. To this day, my property has not been returned, a copy of the sworn complaint for the warrant has been sealed "SECRET" and I am not entilted to the contents. So much for confronting your accuser?? No charges have been filed against me, and the U.S. Attorney refuses to respond to my demands to go before a Federal Grand Jury. The video tapes from TSA, which would prove my innocence is being refused for release for defense. Yet, TSA employees can tell the media lies and stories about me, devulge "Classified" documents to the news media in the form of emails and memo's from Homeland Security insiders who are sympathetic to disrupting TSA and Homeland Security. The news media and reporters who covered this story provided me with these "Classified" documents, and I am waiting for Homeland Security to try to keep them from me for my defense. When thirty (30) FBI Joint Terrrorism Task Force Agents surrounded my home, pointed machines and handguns at me and my wife, for four hours handcuffed they (FBI and Homeland Security) drew the line in the sand, and if they cross it again, a war will begin that our U.S. Government will remember for ten (10) years. I will spill my guts on Government Secrets the likes that "Colonel Oliver North" has ever seen. I will give up my "National Security Clearance" to put a stop to the Sadistic Nazism and Third Reich that the President of the United States calls "Homeland Security". The reins must be pulled in by Congress and the President and tell the FBI, TSA and Homeland Security that you cannot continue to violate the civil rights of the American People. I would like to ask for your help in prosecuting High Crimes and Misdemeanor and Treason on the part of local, state and federal officials. It is no joke.
