Judge Allows Suit Against Abu Ghraib Military Contractor

On Tuesday, U.S. District Court Judge James Robertson of the District of Columbia denied a motion to dismiss a civil suit against CACI International, a military contractor whose interrogators are accused of participating in the abuse of 200 Iraqi detainees at the Abu Ghraib prison.  Judge Robertson also granted a motion to dismiss a similar suit against Titan Corp., which supplied interpreters to the prison.

Judge Robertson rejected CACI's argument that it should enjoy immunity on account of having served under the U.S. military, partly on the grounds that CACI maintained a separate chain of command and may not have answered directly to military authorities.  According to David Remes of Covington & Burling LLP, who represents several Guantanamo detainees, "A military contractor is going to have to think twice . . . when it is brought in to play a role the military has typically played."
