ACS National Convention Video: "What's At Stake: Law and Justice Policies in a New Administration"
The first full day of the 2008 ACS National Convention began this morning with a vigorous exchange about the policies of the next administration. The discussion took on even greater import in the wake of the U.S. Supreme Court decision in Boumediene. Video from the discussion is available here. "Activist" had been re-defined to mean "strikes down a statute." But, by that definition, the recent California Supreme Court decision in the Marriage Cases was "activist" and so too was the Boudedienne case on habeas corpus, as both struck down statutes. Given the good odds that Obama will win, isn't it time we discreetly retired that new definition of "activist"? That is, it may have been a politically useful piece of rhetoric if the US Supreme Court were to stay in conservative hands, but could come back to bite us if Obama gets 2-3 appointments. Or perhaps I'm overthinking this in suggesting that we should have any intellectual consistency on the use of the word activist.
