Supreme Court Rules in New York City Board of Education v. Tom F.
Scotusblog reports that the Supreme Court issued an opinion today that "upheld an appeals court ruling that parents of a disabled child are entitled to reimbursement of private school tuition even if the child has not previously received any public special education services."
In New York City Board of Education v. Tom F., the Court split 4-4, which has the effect of upholding the U.S. Court of Appeals for the Second Circuit's decision, but has no precedential value for other cases. The opinion is available here. The case was argued on the first day of this Term, Monday, October 1, 2007.
